Terms of Use & Service

These Terms explain the rules for using our website and requesting, approving, scheduling, and receiving services from Lumpkin Fix and Clean, LLC.

Last updated: September 18, 2026

These Terms of Use & Service (“Terms”) govern your use of the Lumpkin Fix and Clean, LLC website and any request for, scheduling of, approval of, or payment for services provided by Lumpkin Fix and Clean, LLC (“Lumpkin Fix and Clean,” “we,” “us,” or “our”).

By using our website, submitting a contact or quote request, approving a proposal, authorizing work, scheduling service, making a deposit or payment, or otherwise accepting services, you agree to these Terms.

If you do not agree to these Terms, please do not use our website or request services from us.

1. SERVICES

Lumpkin Fix and Clean provides cleaning, property-turnover support, minor repairs, maintenance, touch-ups, punch-list work, organization, preparation, and other property-support services as specifically described in an approved estimate, proposal, work order, invoice, or written confirmation.

Services may be provided for residential properties, rental properties, short-term rentals, commercial properties, and other approved locations.

All services are subject to availability, scheduling, property conditions, access, safety requirements, materials, and written approval of the final scope of work.

2. ESTIMATES, PROPOSALS, AND APPROVED SCOPE

Estimates, proposals, and quotes are based on the listed scope of work, quantities, access information, visible site conditions, materials, and information available when the estimate is prepared.

An estimate or quote is not a guarantee that all conditions, labor, materials, time, or costs are known before service begins. Hidden conditions, changed conditions, additional rooms or items, damage, access limitations, material needs, safety concerns, or work outside the approved scope may require a revised estimate, change order, additional approval, rescheduling, or referral to another provider.

The approved estimate, proposal, work order, invoice, or written confirmation controls the specific services to be performed. We are not required to perform work that is not included in the approved scope.

3. ADDED WORK AND CHANGES

Any added services, changed conditions, additional labor, materials, disposal, equipment, travel, return visits, repairs, or work outside the approved scope require customer approval before the additional work is performed or billed.

Additional charges may apply for:

• Additional rooms, areas, items, labor, repairs, materials, supplies, disposal, equipment rental, parking, tolls, permits, delivery, travel, mileage, taxes, return visits, or other job-specific costs

• Conditions that were hidden, not disclosed, not reasonably visible, or different from the information provided before service

• Changes requested by the customer after the estimate, proposal, work order, or appointment has been approved

• Emergency, after-hours, rush, or special scheduling requests, when approved

We may pause, reschedule, or decline work if approval is needed and cannot be obtained.

4. PRICING, FEES, AND PAYMENT

Pricing, labor rates, minimum charges, fees, deposits, payment timing, and accepted payment methods may be stated in an estimate, proposal, work order, invoice, booking confirmation, or other written communication.

Labor or service minimums are separate from any applicable service-visit, travel, setup, cancellation, lockout, no-access, or other approved fee unless expressly stated otherwise.

Materials, parts, supplies, disposal, equipment rental, parking, tolls, permits, delivery, extended travel or mileage, taxes, after-hours or emergency charges, and other approved job-specific costs are additional unless specifically listed as included.

Payment is due according to the terms stated in the applicable estimate, proposal, invoice, or written agreement. We may require a deposit, payment authorization, or payment in advance before scheduling or beginning certain services.

5. CUSTOMER RESPONSIBILITIES

You are responsible for providing complete and accurate information needed for us to review, quote, schedule, and perform services.

You agree to:

• Provide safe, timely, and lawful access to the property and approved work areas

• Provide correct property addresses, unit numbers, gate codes, lockbox details, keys, parking information, property rules, contact information, and access instructions

• Disclose known property conditions, prior damage, hazards, restrictions, safety concerns, building rules, tenant or guest occupancy, pets, alarms, utility limitations, and other conditions that may affect the work

• Obtain authorization from the owner, landlord, property manager, association, tenant, business, or other responsible party before requesting services

• Obtain any approvals, permissions, permits, or access authorization required for the approved work

• Provide customer-supplied items, instructions, hardware, parts, fixtures, materials, utilities, or product information when the approved scope requires them

• Ensure customer-provided items are complete, compatible, functional, safe, and suitable for the intended work

• Keep children, pets, guests, tenants, employees, and other persons away from active work areas when necessary for safety

• Review estimates, proposals, work orders, change requests, invoices, and service communications promptly

Failure to provide safe access, required approvals, accurate information, or suitable materials may result in delays, additional charges, rescheduling, cancellation, incomplete work, or a no-access fee.

6. ACCESS, LOCKOUTS, AND NO-ACCESS APPOINTMENTS

You are responsible for ensuring that our team can access the approved service location at the scheduled time.

If we arrive for a scheduled appointment and cannot begin work because of unavailable access, incorrect access instructions, a missing key, lockbox failure, gate issue, occupied or unsafe conditions, missing approval, unavailable decision-maker, undisclosed restrictions, or another condition outside our control, we may reschedule the appointment.

A cancellation, lockout, no-access, service-visit, travel, setup, or other approved fee may apply when supported by the appointment record, approved pricing policy, estimate, work order, or invoice.

No-access fees may cover reserved appointment time, scheduling, dispatch, travel, and arrival when services cannot begin. No on-site work is required for an approved no-access fee to apply.

7. MATERIALS, PARTS, AND CUSTOMER-PROVIDED ITEMS

Unless specifically stated otherwise in writing, customer-provided items, parts, hardware, fixtures, mounts, appliances, remotes, keys, access codes, product information, and instructions must be complete, safe, functional, compatible, and suitable for the intended work.

We are not responsible for delays, extra visits, incomplete work, or damage caused by defective, missing, incompatible, unsafe, unsuitable, or improperly manufactured customer-provided items or materials.

If additional materials, parts, supplies, delivery, disposal, equipment rental, or other costs are required, we will seek approval when reasonably practical before incurring or billing those costs.

8. LIMITS OF SERVICE AND LICENSED-TRADE WORK

Our services are limited to the approved scope of work.

Unless separately approved in writing and legally permitted, we do not provide or guarantee:

• Electrical installation, concealed wiring, panel work, or electrical-code work

• Plumbing work requiring a licensed plumber or permit

• HVAC, gas, roofing, structural, foundation, engineering, excavation, or major construction work

• Mold remediation, asbestos work, lead abatement, hazardous-material remediation, pest treatment, biohazard cleanup, or other specialized remediation

• Code-compliance determinations, formal inspections, professional certifications, or legal determinations

• Work that requires a licensed trade, permit, inspection, specialized equipment, or qualified third-party provider

We may recommend that you consult or hire a licensed, qualified, or specialized professional when conditions or requested work fall outside our approved scope or legal authority.

9. PROPERTY CONDITIONS AND UNFORESEEN CONDITIONS

Services are based on visible conditions and the information available before and during service.

We are not responsible for hidden or pre-existing conditions, concealed damage, latent defects, moisture, water intrusion, mold, mildew, pest activity, structural issues, unsafe wiring, code violations, faulty materials, prior improper repairs, or conditions not reasonably visible or disclosed before work begins.

If unforeseen conditions are discovered, we may pause work, document the condition, recommend next steps, request additional approval, revise the scope, or refer you to an appropriate provider.

10. CLEANING, PAINTING, AND SERVICE RESULTS

Cleaning, painting, maintenance, and property-support services are performed with reasonable care based on visible conditions, access, materials, and the approved scope of work.

Complete removal of stains, odors, grease, buildup, discoloration, pet urine, wear, damage, mold, mildew, prior repairs, or restoration to like-new condition is not guaranteed.

Painting and touch-up results may vary because of surface condition, texture, paint age, color matching, sheen, lighting, moisture, prior repairs, previous coatings, product availability, wall movement, settling, and other existing conditions.

We do not guarantee an exact paint-color match, exact sheen match, invisible repair, or restoration of damaged, worn, aged, stained, or previously repaired surfaces to original condition.

11. PHOTOS, DOCUMENTATION, AND COMMUNICATIONS

We may take or receive photos, videos, notes, checklists, work orders, messages, and other documentation to evaluate requests, prepare estimates, document property conditions, coordinate services, record completed work, resolve questions, and maintain business records.

By requesting services, you authorize us to use reasonable property documentation for these business purposes.

You represent that you have authority to provide access information, property information, photos, files, and instructions related to the requested work.

12. SCHEDULING AND CANCELLATIONS

Appointment times are subject to availability, service conditions, weather, access, materials, staffing, prior appointments, and other factors that may affect scheduling.

We may reschedule or adjust an appointment when reasonably necessary because of weather, unsafe conditions, material delays, access issues, emergencies, illness, staffing needs, customer-requested changes, or other circumstances outside our reasonable control.

If you need to cancel or reschedule, please contact us as soon as possible. A cancellation, late-cancellation, lockout, no-access, service-visit, travel, setup, or other approved fee may apply based on the appointment, reserved time, travel, and written pricing terms.

13. LIMITED WORKMANSHIP WARRANTY

Lumpkin Fix and Clean provides a one-year limited workmanship warranty on labor directly performed by our company, unless otherwise stated in writing.

If an issue is determined to result directly from our workmanship, we will inspect the concern and, when appropriate, correct the covered workmanship issue at no additional labor charge.

This limited warranty applies only to the original approved scope of work.

This limited warranty does not cover:

• Customer-supplied items, parts, hardware, fixtures, appliances, materials, or products

• Manufacturer, product, or material defects

• Normal wear and tear

• Misuse, abuse, accidental damage, neglect, or damage caused by others

• Hidden or pre-existing conditions

• Weather, moisture, water, pests, mold, mildew, structural damage, settlement, movement, or surface failure

• Ordinary cleaning limitations

• Stains, odors, discoloration, pet urine, wear, damage, grease, buildup, or other conditions that could not reasonably be removed under the approved scope

• Color variation, sheen variation, paint-matching limitations, or changes caused by lighting, age, or prior coatings

• Work altered, repaired, replaced, or affected by another person or company after our service

• Any work outside the original approved scope

This limited warranty is not transferable and does not create a warranty for third-party work, customer-provided materials, or conditions outside our control.

14. SERVICE CONCERNS AND AVAILABLE REMEDY

If you have a concern about completed work, please notify us promptly and allow us a reasonable opportunity to inspect and address the concern before arranging correction by another provider.

For a covered workmanship issue, the available remedy is limited to inspection and, when appropriate, reasonable correction of the original covered work.

We do not provide cash refunds for completed services. Correction is limited to the original approved scope and does not include cash refunds, replacement property, third-party repair costs, lost use, lost income, lost rental revenue, consequential damages, or other indirect damages.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Lumpkin Fix and Clean is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost use, lost profits, lost rental income, loss of business opportunity, business interruption, loss of goodwill, or third-party claims.

Our total liability arising from a specific service claim will not exceed the amount paid to Lumpkin Fix and Clean for the specific service that gave rise to the claim, except where applicable law does not allow that limitation.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
